8. ARBITRATION
You and Company agree that any dispute, claim, or controversy arising out of or relating to this Privacy Policy (a “Dispute”) will be settled exclusively through final and binding individual arbitration, rather than in court. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration provision. YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER OF ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise peside over any form of a representative or class proceeding. The arbitration will be administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules then in effect. A single neutral arbitrator will be appointed and the arbitration will occur in Harris County, Texas.
